By accessing or using 3dplotter.xyz ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.

3dplotter.xyz provides:

• STL files for 3D-printable pen plotter attachments for Bambu Lab printers
• A web application for generating G-code from text, images, and drawings
• The Bridge desktop application for remote printer connectivity (subscription-based)
• Calibration tools and single-stroke fonts for pen plotting

Account Creation: You must provide accurate and complete information when creating an account.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Age Requirement: You must be at least 16 years old to use this Service.

Account Termination: We reserve the right to suspend or terminate accounts that violate these terms.

Web App Purchase:

• The web app is a one-time purchase of €29.90 with lifetime access
• Includes STL files, G-code generator, and 1 year of free Bridge access
• All sales are final; refunds are provided at our discretion

Bridge Subscription:

• Bridge is an optional yearly subscription at €16.99/year
• First year is free with web app purchase
• Subscriptions auto-renew unless cancelled before the renewal date
• You can cancel anytime; access continues until the end of the billing period

Payment Processing: All payments are processed securely by Stripe. We do not store your payment card details.

BY COMPLETING YOUR PURCHASE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

• Instant Digital Delivery: All products are digital goods delivered instantly and automatically upon successful payment. You will receive immediate access to all purchased content including STL files, the web application, and any included services.
• Waiver of Withdrawal Right: In accordance with EU Consumer Rights Directive (2011/83/EU) Article 16(m), you expressly consent to immediate delivery of digital content and acknowledge that you lose your right of withdrawal once the digital content has been accessed or downloaded.
• Confirmation of Access: Upon purchase, you will receive email confirmation with access credentials. Your first login to the service constitutes acknowledgment of delivery and receipt of the digital products.
• Activity Logging: We maintain comprehensive logs of all account activity including login times, downloads, G-code generations, and feature usage. These logs serve as proof of delivery and usage of our services.

All sales are final. Due to the nature of digital products, we do not offer refunds once the product has been delivered.

Digital Product Delivery:

• This is a digital product delivered instantly upon purchase
• You receive immediate access to all content including STL files, the web application, and all features
• In accordance with EU Consumer Rights Directive Article 16(m), you waive your right of withdrawal by consenting to immediate delivery at checkout

By completing your purchase, you acknowledge that:

• This is a final sale with no refunds available
• You consent to immediate delivery of digital content
• You waive any right of withdrawal or cooling-off period
• You have reviewed the product features and pricing before purchasing

Payment Disputes:

If you have concerns about your purchase, please contact us at [email protected] before contacting your bank. We're happy to help resolve any issues. Filing a chargeback for a legitimately delivered digital product may result in:

• Termination of your license and account access
• Submission of delivery evidence to your payment provider (access logs, usage data, terms acceptance)
• Recovery of chargeback fees and administrative costs

Our Content: The Service, including all software, designs, graphics, algorithms, source code, STL files, fonts, and documentation, is owned exclusively by 3DPlotter and protected by international intellectual property laws, including copyright, trade secret, and patent laws.

License Grant: Upon valid purchase and subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the web application for personal or internal business purposes
• Download and 3D print the STL files for your own personal use
• Generate and use G-code for your own pen plotting projects

License Restrictions - You May NOT:

• Copy, redistribute, share, sell, or sublicense any STL files, software, or digital content
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use our intellectual property to create competing products or services
• Share your account credentials or allow others to access the Service through your account
• Upload, share, or distribute our STL files on any file-sharing platform, 3D model repository, or other website
• Claim ownership of any of our intellectual property

License Termination: This license is automatically and immediately terminated if you:

• File a chargeback or payment dispute
• Violate any of these Terms of Service
• Engage in any unauthorized use or distribution of our intellectual property
• Share your account with others or allow unauthorized access

Post-Termination Obligations: Upon license termination, you must immediately:

• Cease all use of the Service and any downloaded content
• Delete all copies of STL files, G-code, and other digital content in your possession
• Remove any 3D printed items created from our STL files from commercial use (if applicable)

IP Infringement Consequences: Unauthorized use, copying, or distribution of our intellectual property may result in:

• Immediate account termination without refund
• DMCA takedown notices to any platforms hosting our content
• Legal action seeking injunctive relief and monetary damages
• Statutory damages of up to €150,000 per work infringed under applicable copyright laws

Your Content: You retain ownership of any designs, images, or content you create using our Service. By using our Service, you grant us a limited license to process your content solely for providing the Service.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others
• Use the Service to create content that infringes on others' rights
• Redistribute or resell STL files or generated G-code commercially

Fraud Monitoring: We employ fraud detection systems and reserve the right to:

• Verify your identity and payment information before or after purchase
• Delay or cancel orders that appear fraudulent
• Limit or restrict account access if suspicious activity is detected
• Report suspected fraud to relevant authorities and payment processors

Data We Collect for Fraud Prevention:

• IP addresses and geolocation data at time of purchase and each login
• Device fingerprints and browser information
• Payment method details and billing address verification
• Complete activity logs including all downloads, generations, and feature usage
• Timestamps of all account actions

Evidence Retention: We retain all transaction records, access logs, and usage data for a minimum of 7 years. This data may be used as evidence in chargeback disputes, fraud investigations, or legal proceedings.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

3D Printing Disclaimer: You use the STL files and G-code at your own risk. We are not responsible for any damage to your 3D printer, pen plotter attachment, or other equipment resulting from the use of our Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3DPLOTTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless 3DPlotter, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these terms.

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable member state where the Service is operated. Any disputes shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through a prominent notice on our website. Your continued use of the Service after changes constitutes acceptance of the new terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
